Terms of Service

1. Who we are

jaydesigns.shop (the "site") is run by Jay Designs ("Jay Designs", "we", "us", "our"). These terms cover everything on the site: browsing it, buying products, requesting custom work and using any file you get from us. 2. Agreeing to these terms

By using the site, buying a product or requesting custom work, you agree to these Terms of Service, our Refund Policy and our Privacy Policy. If you don't agree, don't use the site and don't buy anything.

At checkout you must tick a box confirming that you agree before the payment form appears. We keep a record of that agreement, including when you gave it, from which device. The version of these terms shown when you bought is the one that applies to that order.

3. Who can buy, and your account

• You need a free account to buy, including free downloads. Everything you buy is kept in your account so you can download it again.
• Give a real email address you can use, keep your password private, and don't share your account. You're responsible for everything done with it. Tell us straight away if you think someone else has used it.
• We record each sign-in (time and device) to protect your account and to confirm purchases if a payment is disputed.
• We may suspend or close accounts that break these terms or are used for fraud. Purchases on a closed account are not refunded.
• You must be at least 18, or have the permission of a parent or legal guardian who agrees to these terms on your behalf and is responsible for your purchases.
• You must only use a payment method that belongs to you or that you have permission to use. If someone else in your household paid without the cardholder's permission, that is between them and the cardholder. It does not make the order refundable.
• Using a stolen or unauthorized card is fraud. We report it.

4. Our products

• Everything we sell is digital: templates, graphics, GFX packs, server files and similar. Nothing is shipped.
• Previews, images and videos show what's included. Colours and appearance can differ slightly between screens and software.
• Many products need other software or platforms, such as design or animation software, or a FiveM server and its frameworks. It's your job to check that you have what's needed and that the product suits your setup before you buy. Read the product description: it lists what's included.
• We aren't affiliated with or endorsed by Cfx.re, FiveM, Rockstar Games, Take-Two Interactive, Discord, or any software maker, game, platform or brand mentioned on the site. Their names and trademarks belong to their owners.

5. Prices and payment

• Prices are in US dollars. Your bank may add its own fees for foreign or currency-converted payments.
• Payments are processed by Stripe. We never see or store your full card number.
• Discount codes must be entered before you pay, can't be combined unless we say so, have no cash value and can't be applied to past orders.
• We can change prices at any time. A price change never affects an order you've already paid for, and a later sale or discount is not grounds for a refund or price adjustment.
• If a product is listed at a clearly wrong price because of a mistake, we may cancel that order before delivering it and return your payment instead.

6. Delivery

• Products are delivered electronically. Right after checkout you're taken to your private download page, where you can download your files (or open their download link). Some files may instead be sent to you on Discord. An order counts as delivered once the files are made available to you.
• Your download page is personal. Don't share its link. You can download your files as often as you need, and we record every download.
• Your purchases are also listed in your account, where you can download them again any time.
• Lost your download page? Find it at jaydesigns.shop/order with your order number and the email you used at checkout.
• If your files don't arrive or won't open, contact us within 7 days of your order with your order number. We'll send them again or fix them. That is the remedy: not a refund.
• Keep your own copy of your files. We may re-send old orders as a courtesy, but we don't have to after 30 days.

7. Custom work

• Requests: sending a request through the site or Discord is not an order, and we don't have to accept it. An order exists once we confirm the price and what's included, and you pay.
• Payment first: custom work is paid in full before work begins, unless we agree in writing to a deposit. Deposits are non-refundable.
• No cancellations: once you pay, your order is final. Your slot is reserved and work begins. You can't cancel it and you won't get a refund at any stage: before work starts, during it or after delivery.
• Revisions: your quote says how many rounds of revisions are included. If it doesn't, two rounds of reasonable changes to the agreed design are included. New ideas or a different direction after work has started may cost extra. Revisions are how we make the design right, not refunds.
• Timelines: deadlines are targets, not guarantees. We work to meet the deadline you request, but a delay is not grounds for a refund or a chargeback.
• Your materials: you confirm you have the right to use any logo, image, name or reference you send us, and you're responsible for them.
• Going quiet: if you stop replying for 30 days, we may treat the order as finished and deliver what has been completed. No refund is due.
• Ownership: once you've paid in full, you can use the final design for your server, community or brand. Unless we agree otherwise, we keep the right to show the work in our portfolio and on social media. Editable source files (such as PSD or AEP) are only included if your quote says so.
• If we cancel: if we cancel a custom order ourselves before delivering any work, we'll return what you paid. This is our decision, not a way for you to cancel.

8. Your license to use our files

Buying a product (or downloading a free one) gives you a personal, non-exclusive, non-transferable license. You don't buy the design itself: Jay Designs keeps all copyright and ownership.

You may: use the files for your own server, community, stream, brand or project, and edit them as much as you like for that use.

You may not:

• resell, share, give away, trade or redistribute the files, edited or not;
• upload them to leak sites, public drives, Discord servers or marketplaces;
• include them in another pack, template or product, or use them to make templates for sale;
• claim the design as your own work.

One purchase covers one person or one community. Breaking these rules ends your license immediately with no refund. We may file takedown notices, ban you and take further action.

9. All sales are final

Every purchase is final. We do not offer refunds, returns, exchanges or cancellations for shop products or custom work. The full rules, including the narrow cases where we re-send or fix files, are in our Refund Policy, which is part of these terms.

10. Chargebacks and payment disputes

• Contact us first. If something is wrong, open a ticket in discord.gg/jaydzn and give us the chance to fix it. By buying, you agree to do this before contacting your bank.
• Disputing a charge for an order you made, or for files you received, breaks these terms.
• We contest every dispute. We send your bank the records we keep: your agreement to these terms (with time and device), the payment's verification checks, delivery and access records, and our messages with you.
• If you open a chargeback or dispute: your license to everything you've bought from us ends; your account is closed; you're permanently banned from buying from us, ordering custom work and our Discord server; and we may report a false dispute to the payment processor and the authorities, and seek the disputed amount plus the fees it cost us, as the law allows.

11. Using the site

Don't try to break, overload, scrape or get unauthorized access to the site; don't send spam or fake requests; and don't use the site for anything illegal. We may block anyone who does.

12. Our content

The site's designs, previews, product files, text and branding belong to Jay Designs and are protected by copyright. Apart from the license in section 8, you may not copy or use them.

13. No guarantees

Products are provided "as is" and "as available", as described on their product pages. As far as the law allows, we make no other promises, including that a product will work with every version of other software, frameworks or mods, that it will meet your particular needs, or that the site will always be available and error-free.

14. Limit of our liability

As far as the law allows, we aren't liable for indirect, incidental or consequential losses, such as lost profits, lost data, server downtime or harm to your community or reputation. Our total liability for any claim about an order is limited to the amount you paid for that order.

15. Your responsibility

You agree to cover us against claims, losses and costs (including reasonable legal fees) that arise from your misuse of our files, from materials you send us, or from your breaking these terms.

16. Refusing service

We may refuse or cancel any request, and suspend or ban anyone who breaks these terms, abuses or harasses us or our community, or attempts fraud. Bans for breaking these terms come with no refund.

17. Changes to these terms

We may update these terms. The date at the top shows the latest version. Each order is governed by the version you agreed to at checkout, and continuing to use the site after a change means you accept the new version.

18. Governing law

These terms are governed by the laws of Texas, USA. If you have a complaint, contact us first and give us 30 days to resolve it. Any legal claim must be brought in the courts of Texas, USA, unless the law where you live says otherwise.

19. If part of these terms can't be enforced

If any part of these terms is found invalid, the rest still applies. Nothing in these terms takes away rights you have under laws that can't be waived.
